Terms of Service for Punch List AI app

These Terms of Service (“Terms”) govern your use of the PunchListAI mobile application (the “App”), provided by Nice Express (“we”, “us”, “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the App, you confirm that:

  • You are at least 13 years of age (or the minimum age in your jurisdiction).
  • You have the authority to enter into these Terms.
  • You will use the App in compliance with all applicable laws and regulations.

If you do not agree with these Terms, do not use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iOS devices that you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

You may not:

  • Reverse-engineer, decompile, or disassemble the App.
  • Distribute, sublicense, lease, or sell the App.
  • Use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services.
  • Use the App to upload or analyze content that infringes any third party’s rights.

3. Subscriptions and Payments

3.1 Free Trial

PunchListAI offers a 7-day free trial of the Pro tier. You will not be charged during the trial period if you cancel before the trial ends.

3.2 Subscriptions

PunchListAI Pro is available via auto-renewable subscription:

  • Monthly: USD 9.99 per month, billed monthly.
  • Annual: USD 59.99 per year, billed annually (savings of approximately 50% compared to monthly).

Prices may vary by region and are subject to change.

3.3 Renewal and Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. To cancel:

  1. Open the Settings app on your iOS device.
  2. Tap your Apple ID at the top.
  3. Tap Subscriptions.
  4. Select PunchListAI and tap Cancel Subscription.

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

3.4 Payment Processing

All payments are processed by Apple Inc. through the App Store. We do not see or store your payment information. Refunds are subject to Apple’s refund policy: https://reportaproblem.apple.com

3.5 Free Tier

PunchListAI offers a free tier with the following limits:

  • 1 active project
  • 5 issues per project
  • 3 photos per issue
  • PDF reports include a watermark and footer notice

The free tier is provided “as is” without guarantees of continued availability. We reserve the right to modify the free tier limits with reasonable notice.

4. Your Content

4.1 Ownership

You retain all ownership rights to the content you create using the App, including project information, photos, annotations, notes, and reports (“Your Content”).

4.2 Storage and Backup

Your Content is stored locally on your device. iOS may include the App’s data in your iCloud backup depending on your device backup settings. We do not have access to your iCloud backups.

4.3 AI Analysis

When you initiate an AI analysis, the photo is transmitted to Anthropic’s Claude Vision API for processing. By using the AI feature, you acknowledge:

  • The photo is sent to a third-party service (Anthropic).
  • The AI-generated description is not guaranteed to be accurate.
  • You are responsible for verifying any AI-generated information before relying on it.
  • You should not analyze photos containing sensitive personal information, copyrighted materials you do not own, or content prohibited by Anthropic’s Acceptable Use Policy.

4.4 Responsibility for Content

You are solely responsible for:

  • The accuracy and legality of Your Content.
  • Obtaining all necessary permissions for the photos and information you upload.
  • Ensuring Your Content does not infringe on the rights of any third party.

5. AI Disclaimer

PunchListAI uses artificial intelligence (Anthropic’s Claude Vision) to analyze photos and generate inspection reports. AI-generated content is provided for informational purposes only and should not be relied upon as a substitute for professional inspection, engineering, or legal advice.

You acknowledge and agree that:

  • AI analyses may contain errors, inaccuracies, or omissions.
  • You should independently verify all AI-generated information.
  • We are not responsible for any decisions, actions, or omissions taken in reliance on AI-generated content.
  • For safety-critical defects (structural, electrical, gas, etc.), you should consult a licensed professional.

6. Service Availability

We strive to keep the App available and functioning, but we do not guarantee uninterrupted service. The App may experience downtime due to:

  • Maintenance and updates
  • Third-party service interruptions (Anthropic API, Apple services)
  • Network issues
  • Force majeure events

7. Intellectual Property

All intellectual property rights in the App (excluding Your Content) — including software, design, trademarks, logos, and branding — are owned by Nice Express or its licensors. These Terms do not transfer any intellectual property rights to you.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will meet your specific requirements.
  • The App will be uninterrupted, timely, secure, or error-free.
  • The AI-generated content will be accurate, complete, or reliable.
  • Defects in the App will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NICE EXPRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Nice Express, its affiliates, and employees from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms
  • Your use of the App
  • Your Content
  • Your violation of any rights of a third party

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. Upon termination:

  • Your license to use the App ends.
  • You should uninstall the App from your devices.
  • Active subscriptions are not refunded for partial periods.

You may stop using the App at any time by uninstalling it.

13. Changes to Terms

We may update these Terms from time to time. We will indicate the date of the latest revision at the top. Continued use of the App after changes constitutes acceptance of the updated Terms. If changes are material, we may notify you within the App.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Nice Express is established, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of that jurisdiction.

If you are an EU consumer, this clause does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

15. Apple Specific Terms

You acknowledge that these Terms are between you and Nice Express, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. Apple has no other warranty obligations.

You and Nice Express acknowledge that Apple is a third-party beneficiary of these Terms and will have the right to enforce them against you.
